We do not use these words in our daily life but we have to use them depending on how to use them in laws and ordinances.

“法制執務提要(第二次改訂新版)” shows it like the following:

This expression by no means lack the meaing of obligation like “must” and sometimes used as the same meaning as it, but generally this does not give a clear solution to things and we use it to include some implications and indicate some general principles and policies. This is often used to restrict administrative organs, etc.

“とする。”
This expression is similar to “である。”, but “である。” is used to explain just a fact while this includes somewhat obligations.
