CONPHIC Co., Ltd. has many opportunities to develop tools for e-Legislation (computerized legislation) and deal with legal data. The other day I was asked about the difference of “法,” “法令” and “法例.”

“法制執務提要<新版>” (a book about legislation) (Author: Tatsuo SATO, former director-general of the Cabinet Legislation Bureau) shows the difference like the following:
“法”: all the things which meet the nation of laws even if they are statutes, common laws or other lex non scripta.
“法令”: The meaning of “法令” differs depending on purport of Articles, but they are only statutes and does not include treaties.
“法例”: This is the title of the law “The Act on General Rules for Application of Laws.” This law is lapsed by total rivision by “Act on General Rules for Application of Laws.”

As the evidence of why laws and regulations do not include treaties, Article 3 paragraph 2 of Civil Law indicate “Unless otherwise provided by applicable laws, regulations or treaties, foreign nationals shall enjoy private rights.”

You might be able to understand the intent of the drafters of laws and regulations by reading them considering the use and definition of terms and considering the reason of the rivision of terms.
