I would introduce a rule for how to use “及び” and “並びに”.
“法制執務提要” is a book about legislation rules and shows the rules of how to use these terms like the following:
When there are more than two parallel words and you make a couple of group with “and ” in Japanese sentences, if the words are at the same level like noun or verb, you should use “及び”. (In this case, you should connect other words than the last word with comma.) If a group of words (including “及び”) and another group are at the same level (parallel groups), you should use “並びに”. This it true of the case of more than three groups (you should use “並びに”). That is “及び” is used only for the lowest level of group of words.
・Two parallel words
A 及び B
(A and B) = at the same level (group)
・More than three parallel words
A, B 及び C
(A, B and C) = at the same level (group)
・Parallel groups of parallel words
A 及び B 並びに C 及び D
group (A and B) and group (C and D) = at the same level (parallel groups)
In Artcle 28 Paragraph 2 of Companies Act, you can find the following sentence:
株式会社の成立後に譲り受けることを約した財産及びその価額並びにその譲渡人の氏名又は名称
This is a version of parallel groups “A及びB並びにC”.
You can read this sentence as…
（【株式会社の成立後に譲り受けることを約した財産】及び【その価額】）並びに（【その譲渡人の氏名又は名称】）.
Laws are composed of long sentences, so they are often difficult to understand. But I think you can understand them more easily if you read them dividing sentences with “及び” and “並びに”.
The same thing is true of “又は” and “若しくは”. I will introduce these terms in other day in this blog.
